Additionally, Transporter and Shipper may agree that rate

components may be adjusted upward or downward to achieve an agreed

upon overall rate or to collect amounts in accordance with a

specified relationship to prices or other factors (e.g., Fuel Use

and LUFG percentages) agreed to by Transporter and Shipper, so

long as none of the resulting rate components exceed the maximum

rate applicable to that rate component.
