42. FEES AND CONSTRUCTION OF NEW FACILITIES

42.1 In addition to any other charges due under the applicable rate schedule,

Customer shall reimburse Algonquin for the following:

(a) The costs of any facilities installed by Algonquin with Customer's

consent to receive, measure, transport or deliver natural gas for the

account of Customer; and

(b) Any and all filing and approval fees required in connection with

Customer's service agreement that Algonquin is obligated to pay to the

FERC or any other governmental authority having jurisdiction.

Any reimbursement due Algonquin by Customer pursuant to this Section 42.1 shall

be due and payable to Algonquin within ten days of the date of Algonquin's

invoice(s) for same.
