GENERAL TERMS AND CONDITIONS
(continued)
14. CAPACITY RELEASE (continued)
(c) When a release of capacity for a period of thirty-one (31) days
or less is not subject to the bidding requirements under this
Section 14.10, a Releasing Customer may not rollover, extend,
or in any way continue the capacity release to the same
Replacement Customer which utilizes the same capacity or
overlaps such capacity using the thirty-one (31) days or less
bidding exemption described in Section 14.10(a)(1) above until
twenty-eight (28) days after the first release period has
ended. The twenty-eight (28) day hiatus does not apply to any
re-release to the same Replacement Customer that is posted for
bidding or that qualifies for any of the other exemptions from
bidding described in Section 14.10(a) above.
(d) Notwithstanding the standard timelines specified in Section
14.10(b) above, Algonquin shall support a process to allow the
Releasing Customer and the Pre-arranged Customer to create and
finalize pre-arranged non-biddable capacity release
transactions to be effective for a given Gas Day at any time
prior to 7:00 a.m. CCT on the calendar day on which that Gas
Day ends.
