GENERAL TERMS AND CONDITIONS

22. SHIPPERS' RELEASE OF FIRM CAPACITY con't

(11) Whether bids may be submitted that are contingent on

(i) the award of downstream capacity on another

pipeline system, (ii) the success or failure of

another bid for capacity on Transporter's Pipeline

Facilities in the same offer/bid cycle, or (iii) any

other type of contingency specified in the offer; the

deadline for the removal of any contingency is subject

to the provisions of Section 22.11.

(12) Selection of one of the following economic criteria to

be utilized by Transporter in determining the "best

bid": (i) highest rate, (ii) net revenue, or (iii)

present value. If the Shipper does not specify one of

the above criteria, Transporter shall use the

following criteria in determining the "best bid":

(a) net revenue for bids with a term of one Month or

less or

(b) present value for all other bids.

(13) A nondiscriminatory tie breaker to be utilized in

determining the "best bid."

(14) If the offer is for a Temporary Release, whether the

winning bidder has to submit a prepayment and, if so,

what prepayment is required.
