GENERAL TERMS AND CONDITIONS

(14) the economic criteria to be utilized by

Transporter in determining the "best bid"

shall be one of the following (i) highest

rate, (ii) net revenue, or (iii) present

value. If the RELEASING SHIPPER does not

specify the criteria, Transporter shall use

the Present Value Calculation as set forth in

Section 19.6(i) herein to determine the best

bid; and

(15) a nondiscriminatory tie breaker to be

utilized in determining the "best bid" in the

event two or more bids generate the same

result.
