PROCESSES FOR LIQUEFIED NATURAL GAS CERTIFICATES

Traditional Environmental Review Process

Applicant Process   FERC Process
  1. Applicant assesses market need and considers Project feasibility.    
  2. Applicant studies potential site locations.    
  3. Applicant identifies stakeholders.    
  4. Applicant files formal application with the FERC.     1. FERC receives application for project.
    * 2. FERC issues Notice of Intent for preparation of an Environmental Impact Statement (EIS). Opens NEPA scoping period to seek public comments on the project.
    * 3. FERC holds NEPA scoping meeting(s) in the project area. Consults with interested agencies.
      4. FERC issues Preliminary Draft EIS to cooperating agencies for review.
    * 5. FERC issues Draft EIS and opens comment period.
    * 6. FERC holds meeting(s) in the project area to hear public comments on the Draft EIS
      7. FERC responds to comments and revises to Draft EIS.
      8. FERC issues Final EIS.
      9. FERC approves or denies project.
  5. If the project is approved, Applicant may construct and operate the project, only after obtaining Clean Water Act, Coastal Zone Management Act, and Clean Air Act permits.    
     
* 6. If the project is denied, Applicant and/or Public can ask FERC to rehear case or refer to FERC Administrative Law Judge.    
* 7. Applicant and/or Parties can take FERC to Court.
